1. About this agreement

This User Agreement governs your use of pose: Pilates & Home Workout, its exercise content and related legal website (together, “pose” or the “Service”). The operator is Matt (“we”, “us” or “our”). For support, billing questions or legal correspondence, contact matt1232026@gmail.com.

By selecting “Agree & continue” in the app, you agree to this User Agreement and acknowledge that you have read the Privacy Policy. Optional permissions and any consent required for a particular data use are separate choices. Accepting these documents does not authorize advertising tracking or waive your statutory rights. If you do not agree, do not continue using the Service. You may read and save these documents without subscribing.

2. Eligibility and use without an account

pose is intended for adults aged 18 or older who can enter into a binding agreement. We do not require a pose account, password or social sign-in. Your preferences and practice progress are ordinarily held on your device. You are responsible for securing your device and for deciding who can access it.

An Apple Account may be required by Apple to download the app or make a purchase. That is separate from a pose account. Membership restoration depends on the relevant Apple purchase records and the availability of the purchased product. We do not promise that local practice history will transfer to another device. Device backups are controlled by your operating system and settings.

3. Exercise guidance and your safety

pose provides general fitness and movement education. It is not a medical service, medical device, emergency service, diagnosis, treatment, rehabilitation prescription or individualized clinical advice. A visual instructor, animation or generated demonstration should not be understood as evidence of a professional qualification or a personal assessment of your health.

Consider whether a practice is suitable for your circumstances. Seek advice from an appropriately qualified health professional if you are pregnant, recovering from injury or surgery, have a medical condition, or are unsure whether exercise is appropriate. Stop if you experience pain, dizziness, unusual shortness of breath or other concerning symptoms. Contact emergency services when necessary; pose cannot monitor you or provide emergency assistance.

Use a clear, stable space and suitable equipment. Follow a comfortable range of motion and adapt or skip a movement when needed. Timers, suggested repetitions and session schedules are guides, not requirements to push through discomfort. Exercise involves risks, but nothing in this agreement excludes our responsibility where the law does not allow it to be excluded.

4. Plans, content and availability

The Service may offer suggested practice plans, workout demonstrations, timers, audio guidance, captions, reminders, saved practices and progress records. Suggestions are based on the preferences you choose and are not a guarantee of suitability, weight change, body shape, strength gains or any other result. Progress summaries are informational and may be estimates.

Available workouts and features are those described in the app and the purchase information at the time you choose a product. A preview, “coming soon” item or illustration is not a promise that a specific future feature will be delivered on a fixed date. We will not describe an unavailable feature as an existing paid benefit. Your legal remedies for inaccurate descriptions or defective digital content remain intact.

Some functions need internet access, including loading these legal pages, verifying membership and purchasing or restoring access. Other functions may work locally. Network, device and platform interruptions can affect availability. We will take reasonable care in operating the Service and addressing issues brought to our attention.

5. Free access and paid membership

The app may include free access and optional paid access. Before paying, review the specific product, billing period, total price, currency, applicable taxes, included features, trial terms and renewal information shown in the paywall and Apple's purchase confirmation. The confirmed offer governs your purchase. There is no obligation to buy a membership merely because you complete onboarding or create a plan.

A subscription provides access for its stated period, subject to renewal and these terms. A one-time or lifetime product, if expressly offered, is not an auto-renewing subscription. “Lifetime” means access to the benefits described for that product while the applicable Service remains available, subject to your non-waivable consumer rights; it does not mean a guarantee that every future product or feature is included.

6. Billing and automatic renewal

In-app purchases are billed by Apple through your Apple Account and are subject to Apple's applicable terms and payment procedures. We do not receive or store your full payment-card details. RevenueCat helps us verify purchases and determine access, as described in our Privacy Policy.

Auto-renewing subscriptions renew and are charged for the next billing period unless you cancel in time. Apple may process renewal charges before the current period expires. To avoid an unwanted charge, cancel before the deadline shown by Apple; for a trial, Apple's guidance is to cancel at least 24 hours before it ends. Any legally required renewal notices, price-change information or consent requirements continue to apply.

We will not substitute an undisclosed product or increase a confirmed price without following applicable law and Apple's procedures. Taxes, payment failures, billing grace periods and currency handling may affect the final charge or entitlement under Apple's rules.

7. Trials and introductory offers

A free trial or introductory offer is available only when the purchase screen and Apple's confirmation expressly offer it to you. Eligibility may depend on your Apple purchase history or subscription group. Do not assume that every user receives a trial or that all trials have the same length.

If you accept an auto-renewing trial, the paid subscription begins and Apple charges the stated price when the trial ends unless you cancel on time. Review the duration, subsequent charge and billing period before confirming. Trial reminders, if available, are a convenience and depend on permissions and delivery; receiving or missing a reminder does not cancel your subscription. A canceled trial may end immediately under Apple's terms.

8. Canceling and restoring purchases

You can manage an Apple-billed subscription on your iPhone in Settings → your name → Subscriptions → pose, then choose the cancellation option. The app's membership screen may also open Apple's subscription-management interface. See Apple's cancellation instructions for other devices and regional differences.

Cancellation ordinarily stops future renewals; access for an already-paid period is governed by the product, Apple's rules and applicable law. Deleting the app, clearing local data or emailing us does not itself cancel an Apple subscription. We cannot change your Apple Account settings for you.

Use “Restore purchases” with the Apple Account used for the purchase if access is missing. Contact us if restoration does not work. Do not send your Apple password, full card number or security codes. Restoration can recover eligible purchased access but does not restore local workout history that has been deleted.

9. Refunds and consumer remedies

For a purchase billed by Apple, you can request a refund at reportaproblem.apple.com. Apple's eligibility rules and applicable consumer law govern the request. A refund is not guaranteed solely because a subscription was unused or the app was deleted. See Apple's refund guidance. You may also contact us about a defective feature, incorrect description or other service issue.

Nothing here limits rights you may have to receive conforming digital content or services, obtain repair or correction, reduce a price, terminate a contract or receive a refund under mandatory consumer law. In particular, users in the European Economic Area or United Kingdom retain applicable consumer guarantees.

Where a statutory withdrawal period applies, you may have 14 days to withdraw from a distance contract. Exceptions for supplied digital content or fully performed services apply only when the legal conditions are met, including any required prior express request, consent and acknowledgment. Tapping the first-run agreement button alone does not waive a statutory withdrawal right. Contact us or Apple, as appropriate for the purchase, to exercise a right. A clear statement identifying the purchase and your wish to withdraw is sufficient where the law allows; no special wording is required.

10. License and intellectual property

Subject to these terms and any applicable purchase, you may use pose and its content for your own personal, non-commercial practice. The app, branding, videos, audio, illustrations and written content are protected by intellectual-property laws. This permission does not transfer ownership to you.

Do not redistribute or sell our content, remove rights notices, circumvent access controls or use the content to create a competing commercial library without authorization. This does not restrict accessibility uses, interoperability, quotation, fair use or other exceptions that applicable law protects.

For an app obtained from the App Store, Apple's Standard Licensed Application End User License Agreement governs the software license unless an applicable custom license is supplied through the App Store. This agreement sets out the additional Service terms; it does not replace Apple's purchase terms or reduce rights under the applicable software license.

11. Your content and sharing

You retain any rights you have in information and original material you provide, such as an optional display name or a drawn signature. The signature feature is a personal practice keepsake, not an electronic signature for a financial contract or a substitute for the purchase confirmation. We use local entries to provide the features you request, not to claim ownership of your identity or publish your material.

Sharing is optional. If you open the system share sheet and choose a recipient or app, you decide what to send. Review the shared card and destination first. The recipient or third-party platform may retain it under its own policies. Share only material you have a right to share and do not include another person's private information without permission. You do not grant us a general right to use your private practice information in advertising.

12. Responsible use

Use the Service lawfully and without interfering with others or the systems that support it. Do not attempt unauthorized access, introduce malicious code, falsify purchase verification, exploit vulnerabilities to obtain paid access, or impersonate another person in support requests. Report security concerns to our contact email with enough detail to investigate, without disclosing other users' information.

We may take proportionate steps to address unlawful use, fraud or serious security threats. Where appropriate and lawful, we will explain a restriction and provide a way to contact us about an error. A restriction does not remove any refund, appeal or other statutory remedy you may have.

13. Permissions, privacy and communications

The Privacy Policy explains local storage, subscription processing, hosting, support correspondence and your choices. Reminder permission is requested only when you choose to enable reminders. You can change notification permissions in iOS and audio, caption and haptic preferences in the app. Optional permissions are not required merely to accept this agreement.

We may respond to a support request and provide service or legal notices when necessary. Providing your support email does not subscribe you to marketing. We will obtain any legally required permission before sending promotional communications.

14. Third-party services

Apple, RevenueCat, the website host, your email provider and any sharing destination provide services under their own terms and privacy practices. A link is provided for convenience and does not imply endorsement of all external content. We remain responsible for our own obligations, including our selection and use of service providers where applicable law requires it.

Apple is not responsible for providing pose's exercise guidance or ordinary app support. Any Apple rights as a third-party beneficiary and any platform-specific obligations are governed by the applicable App Store software license. You can contact us for support about pose itself.

15. Updates and changes to the Service

We may issue updates to improve security, compatibility, reliability or content. Changes to a paid service will respect applicable notice requirements and your consumer rights. If a change materially and adversely affects a service you purchased, any applicable right to end the contract or obtain a remedy is preserved.

When we materially change this agreement, we will update the date and provide notice through an appropriate channel, such as the app, before applying the change where required. We will request renewed acceptance when appropriate. Changes do not retrospectively remove rights associated with an earlier purchase or dispute.

16. Warranties and limits of responsibility

We will use reasonable care and skill in providing the Service. No general fitness app can guarantee a particular outcome, uninterrupted availability or suitability for every individual. To the extent legally permitted, we do not make additional implied promises beyond those in this agreement and the product description.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable, losses caused solely by your unlawful misuse, or business losses arising from personal consumer use. These limits do not excuse our failure to meet a mandatory duty or override a specific remedy provided by law.

We do not exclude or limit liability for death or personal injury caused by negligence where exclusion is prohibited, fraud or fraudulent misrepresentation, intentional misconduct, gross negligence where protected, or any other liability that cannot lawfully be excluded or limited. Your mandatory consumer and privacy rights remain unaffected. If a local law does not permit a stated limitation, that limitation does not apply to you to that extent.

17. Ending use and resolving concerns

You can stop using pose at any time. You may clear practice data in the app's Preferences, remove the app, and separately cancel any subscription through Apple. Lawful retention of support, purchase or security records is addressed in the Privacy Policy. Rights that need to survive, such as ownership, accrued payment obligations and statutory remedies, remain in effect.

If something goes wrong, email us and describe the issue and the resolution you seek. We will consider the concern in good faith. Contacting us is not a mandatory prerequisite to exercising a statutory right, contacting a regulator or bringing a claim. This agreement does not impose compulsory arbitration or a class-action waiver.

You retain the protection of mandatory laws that apply to consumers in your place of habitual residence and the right to bring a dispute in a competent court available under applicable law. We do not require you to surrender those protections by accepting a foreign governing law or exclusive foreign court.

18. General terms and contact

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law, without replacing a consumer protection with a less protective term. A failure to enforce a provision on one occasion does not waive it generally. We may transfer the Service only subject to applicable law and without reducing your existing contractual or privacy rights.

These Service terms, the applicable product information and any applicable App Store software license form the relevant agreement for their respective subjects. No term here overrides mandatory law. The English text is the published version; a translation, if later supplied, will not reduce rights you have under applicable law.
