1. Agreement to these terms
These Terms of Service (the “Terms”) form an agreement between you and the provider of FocusHuman (“FocusHuman,” “we,” “us,” or “our”) for your use of the FocusHuman iOS app (the “App”). By downloading, accessing, or using the App, you agree to these Terms, the Privacy Policy, and, where applicable, the Membership Agreement and Automatic Renewal Terms.
If you do not agree, do not use the App. If you are using the App on behalf of an organization, you confirm that you have authority to accept these Terms for it.
2. The App
FocusHuman provides tools intended to support personal focus, routines, reflection, and accountability. The App may include timed focus sessions, check-ins, recovery flows, progress views, an optional presence inspection, ambient audio controls, and relationship-style progress features.
The App is not medical, mental-health, educational, emergency, employment, or professional advice. It does not guarantee productivity, wellbeing, a particular outcome, or continuous availability.
3. Eligibility and Apple requirements
You must be able to enter into a binding agreement under the law that applies to you and comply with App Store rules. Your use of the App is also subject to Apple’s applicable media-services terms. Apple is not responsible for providing support for the App except as required by law.
4. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, attempt to extract source code from, or create derivative works of the App except to the extent a restriction is prohibited by applicable law.
5. Your content and responsible use
You are responsible for the text, choices, and other content you enter into the App. Do not enter content that is unlawful, infringes another person’s rights, threatens harm, or is otherwise prohibited by law. FocusHuman does not claim ownership of content you keep locally in the App.
You may not interfere with the App, bypass purchase or access controls, use it to violate law or third-party rights, or use it in a way that could damage, disable, overburden, or impair the App or related services.
6. Camera and device permissions
The presence inspection is optional. If you enable it, you are responsible for obtaining any permission that may be required from people or places visible to your device camera. Use the feature only in a lawful, respectful setting. The App processes the inspection frame on device as described in the Privacy Policy; it is not a surveillance, identity-verification, or security service.
7. Memberships and purchases
Some features may require FocusHuman Bond membership. Prices, included features, and billing period are shown in the App Store purchase flow before you buy. All payments are processed by Apple. Memberships are subject to the Membership Agreement and, for recurring plans, the Automatic Renewal Terms.
8. Ownership
The App, including its software, visual design, audiovisual elements, characters, trademarks, and other materials, is owned by FocusHuman or its licensors and is protected by applicable intellectual-property laws. Except for the license expressly granted above, no rights are granted to you.
9. Changes, availability, and termination
We may change, suspend, or discontinue any part of the App, including a feature or membership benefit, where reasonably necessary. We may update these Terms by posting a revised version with a new effective date. Your continued use after the effective date means you accept the revised Terms to the extent permitted by law.
We may suspend or terminate your license if you materially breach these Terms. You may stop using the App at any time. Sections that by their nature should survive termination will survive.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or suitable for every purpose.
To the maximum extent permitted by law, FocusHuman and its licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or productivity arising from or related to the App. Where liability cannot lawfully be excluded, it is limited to the greater of the amount you paid to use the App in the twelve months before the claim or the minimum amount permitted by law.
11. Governing law and contact
These Terms are governed by the law that applies in the jurisdiction of the FocusHuman provider, excluding conflict-of-law rules, unless mandatory law gives you additional protection.
